Agreement Between Rake of Spades and the User

The Rake of Spades programs are offered to the user conditioned on acceptance without modification of the terms, conditions, and notices contained herein. Use of the Rake of Spades programs and the RakeofSpades.com web site constitutes your agreement to all such terms, conditions, and notices.

"we", "us" and "our" refer to RakeofSpades.com and it's management while "you" and "your" refer to the users of the RakeofSpades.com web site and the services provided.

Privacy

We will never sell or otherwise divulge your email address, name or player ID with anyone. We only require information that is needed in order to calculate your earned rakeback, referral payments and/or promotional rewards.

Your poker room player ID may be displayed when listing standings for promotional competitions. Your RakeofSpades.com usename will be displayed in the account of the Rake of Spades member that referred you to us (if any).

Security

We will never ask you for any passwords to your poker room accounts or any other accounts. All transfers are made over secure connections where your information will not be at risk.

Modification of These Terms and Conditions

We reserve the right to change the terms, conditions and notices under which the our programs are offered. These updates will take effect as soon as they are posted here.

Rakeback & Referral Payment Commitment

We commit to ensuring that you continue to receive rakeback and referral payments for the life of your poker room accounts and the poker room accounts of your referrals given that we continue to receive commission from the poker rooms. For poker rooms that do not send payments automatically for us, reports must be available that provide individual player statistics in order for us to continue sending payments. We will not be able to continue to send payments for individual poker rooms that stop paying our commission or stop providing individual player statistics.

The Rake, Deductions and Payments

The rake, synonymous with net rake, is defined to be the revenue for which we are paid a commission that you generate by playing poker. In general, the rake is calculated as gross cash game rakes and tournament fees minus deductions. Historically, some poker rooms did not include tournament fees in rake calculations, but all rooms that we currently feature do.

Each poker room has a policy in place regarding what fees and/or costs are deducted from each player's gross rake to determine the rake for a given period. Deductions may include, but are not limited to, promotional costs such as bonuses and deposit/withdrawal fees. Each specific policy will be listed on the respective poker room information page. Since poker rooms do take deductions from gross rake totals, it is possible to accrue a negative rake balance for a given payment period.

Rakeback payments are calculated as rake times rakeback rate. Similarly, referral payments are calculated as referral rake times referral rate. Any balances smaller than the minimum transfer amount for a given poker room or payment method (if any) will be carried over to the next payment period. Similarly, any negative rake balances for any payment period are carried forward to the next period.

Rakeback & Referral Rate Determination

The rakeback rates that we offer for each individual poker room are largely determined by the rate of commission that we are offered by said poker room. Similarly, the referral rates that we offer are largely determined by the average rate of commission that we are offered by the poker rooms that we list. The rates and structures of our rakeback and referral programs are subject to change. Reasons for structure change include, but are not limited to, changes in commission rates given to us by the poker rooms, charges and fees charged by the poker rooms or other unforeseen changes related to our programs. The user will be notified of any and all changes as soon as possible.

Chargebacks and Payment

All poker rooms have the right to withhold payments from us in the event that there is reason to believe that a player is using their poker account for fraudulent purposes. In this event they may refuse to release commission to us. While these events are rare, they are nonetheless possible and we reserve the right to delay making payments to you if necessary. If for any reason we are not able to send you your earned rakeback or referral payments, due to failure to provide necessary information, meet conditions of use or other reasons, said rakeback or referral payments will be held over until payment can be made. In order for you to receive payments, we need to access reports from the poker rooms that you have signed up for trough us. These reports may show fields such as, but not limited to, player name, player ID, number of raked hands played for a given period, rake contribution generated for a given period and/or overall rake generated for a given period. By signing up with a poker room through us you are granting us permission to view these reports and are also granting permission for the respective poker room to allow us access to see said reports and the information contained therein.

Poker Room Viability

Although we will attempt to only list reputable poker rooms that will be able to stay in business for the foreseeable future, sometimes poker rooms encounter financial difficulties or fail altogether. In the event that a poker room is not able to pay us the commission that we have earned for your play, you may not be paid the rakeback or referral payments that you have earned. We will make every attempt possible to make sure that you are paid, but in certain cases, payment may not be possible.

VIP Programs

Any VIP programs that we list are under the complete control of the given poker room. We have no control over reward payments, reward rates, promotions or any other value returned to the player under these programs.

No Prohibited or Unlawful Use

You warrant to us that you will not use our web site or services for any purpose that is prohibited by these terms, conditions, and notices or unlawful in the jurisdiction in which you reside. Additionally, it is your duty when signing up to a poker room to make sure that you are not violating any rules governing an account on their network.
